Bedford train crash: Getting legal advice and support if you’ve been injured
Fletchers Solicitors are supporting a number of people injured in the collision. In this article Caroline Morris, Managing Director of Serious Injury at Fletchers explains the next steps for those involved, including getting the right care and support available to them.
On the 19th June 2026, two East Midlands Railway trains collided in Elstow, leaving one dead and over 160 people injured.
nvestigations are ongoing, but initial findings show that there was a fault with one train and a missed red light on another. This caused the train to crash into another which was stationary on the tracks.
For those who were injured and for the family of the driver who lost his life, understanding exactly what happened will be an important part of the process.
But the immediate priority should be ensuring they have access to the very best treatment and rehabilitation in order to recover.
What support is available?
The physical and psychological impact of a major incident often continues long after the immediate aftermath. Accessing the right support is crucial to aiding your recovery and regaining your independence.
A complete care package could include:
- Specialist rehabilitation
- Psychological support for trauma, anxiety or PTSD
- Financial support
- A case manager to advocate for you
- Medical aids, equipment and suitable accommodation
Can those injured in the Bedford train crash claim compensation?
If you were physically or psychologically injured you may be entitled to pursue an injury compensation claim, depending on the circumstances of the incident and the findings of the ongoing investigations.
Fletchers Solicitors is already helping a number of passengers who were involved – ensuring they receive answers throughout the investigation, access to the right rehabilitation and care, and know all the options available to them.
Compensation can assist with a wide range of losses and expenses, including:
- Medical treatment and rehabilitation
- Loss of earnings
- Care and support needs
- Travel and recovery-related expenses
- Psychological injuries and trauma
- Childcare costs
- Domestic services
As well as helping you financially, our solicitors can ensure you get the answers you need about how and why this happened, and identify lessons to prevent another incident in future.
We can help you to find out:
- Could the crash have been prevented?
- Were all the safety systems operating properly?
- Was anything missed in train inspections?
- Were all procedures properly followed?
- What changes must be made to prevent another crash?
What are the next steps for those affected?
A complex investigation is underway, involving the Rail Accident Investigation Branch, British Transport Police and a coroner’s inquest into the death of the train driver, Shaun Burton.
Depending on the circumstances the crash may also result in fines or prosecutions by the Office of Rail and Road regulatory body, or lead to a wider public inquiry to review the safety of British railways.
This multi-agency investigation should rightly scrutinise all the circumstances which led to the crash, to ensure something like this cannot happen again.
But those affected by this incident should remain at the centre of our focus.
For families involved in a major transport incident the process can feel overwhelming; they face a long physical and emotional recovery, and must have meaningful support which shows them they are not alone in navigating complex systems and procedures.
Behind the investigations, reports and recommendations are lives that have been changed forever, ensuring they get the justice they deserve must remain a priority throughout this process and beyond.
Our Personal Injury and Public Inquiry teams have decades worth of experience in supporting individuals through highly complex and traumatic incidents, including victims caught up in the Southport attack, the Nottingham attack and the Liverpool Chandlers Wharf crane collapse.
